THE PRESENT KNOWLEDGE TERMS AND CONDITIONS
- Introduction
These Terms and Conditions govern your use of the Present Knowledge Service.
Please read them carefully as they affect your rights and liabilities under
the law. If you do not agree to these Terms and Conditions, please do not
register for or use The Present Knowledge service. This Agreement is a legal
document, which sets out your rights and obligations, and those of The Present
Knowledge, a company registered in England under registration no 4802507.
Becoming a member and registering for the Present Knowledge Service, you
agree to the terms of this Agreement, and you re-affirm that agreement every
time you use it. Visitors to the Present Knowledge Service who do not register
to become a Member (see 2 below) similarly affirm that they are bound by
this Agreement each time they access The Present Knowledge Service.
- Registration
People who register for the Present Knowledge Service become "Members".You
can be any age to join, if you are under the age of 18 we recommend you
join under the "Family membership" option. If you are under 18
and dont have your own debit card we recommend you ask your parent/guardian
to provide payment details for your membership using an appropriate credit/debit
card. The Membership divides between those who decide to pay our fee for
a full annual membership (which we call "Full Members"), and those
who do not ("Non Members").To use thepresentknowledge.com site
you will require Internet connectivity and appropriate telecommunication
links. We shall not be liable for any telephone or other costs that you
may incur.
You undertake to register for the Present Knowledge using accurate and
current information about yourself including your correct name, and email
address and whether you are under or over 18 years. If you are asked for,
and you provide, details of a credit, debit or charge card; in that event,
you must ensure that (a) you are fully entitled to use that card, and (b)
it has available funds sufficient to cover the charges, which The Present
Knowledge Service deducted from it.
As part of the registration process for the Present Knowledge Service,
you will receive a verification email, the purpose of which is to take reasonable
steps to ensure that the email address you have nominated during registration
is controlled by you. That email contains simple instructions, which you
must follow.
As well as being able to browse the Present Knowledge Service like any
visitor to it, Non Members may:
- see an overview of the Present Knowledge site before joining.
- receive via email a unique randomly selected password to access for
free a full member’s site that has invited you to have access to
their information.
- create unlimited promise vouchers.
- view example wish list page
- view hints & tips page.
- view wish list ideas page.
- view profile example page.
In addition to the facilities available to Non Members, Full Members may:
- enter details relating to personal likes for present buying by completing
'my profile' information which includes: vital statistics, hobbies and
interests, about me, food likes, visits, news..
- create up to date present wish lists which includes: gifts for birthday/christmas,
having a baby and weddings.
- create unlimited promise vouchers
- arrange a party.
- share details of an organised fundraising event, including your sponsor
form.
- add email addresses to their address book, enabling a unique database
generated password to be sent to all invitees in that list. Enabling those
invitees to access your online information.
- Full Membership
As a Full Member, paying our Full Membership fee, you are agreeing to
the Full Membership available to you shortly after that fee is paid. This
means that you do not have the right to cancel your Full Membership
during the cooling-off period which is provided for certain purchases under
the Consumer Protection (Distance Selling) Regulations 2000. Refunds will
be given in exceptional circumstances at the discretion of the management.
Please contact membership@thepresentknowledge.co.uk with full details of
your request for refund and we will reply to you within 48 hours with a decision. All payment
for Full membership is payable via Worldpay
for secure online credit card transactions. The Present Knowledge do not
accept cheques for membership fees.
Your Full Membership will last for twelve months. If you wish to continue
with Full Membership after the expiry of that twelve-month period, we will
enable you to do so, at our then-current terms and prices. But please note
that we reserve the right to change the amount of the fee for Full Membership,
the period, which it covers, the services, which it enables you to obtain,
and other factors from time to time. However, these changes, will not affect
your then-current Full Membership.
- Privacy Policy
The Present Knowledge's Privacy Policy
forms part of this agreement. Any posting on the Present Knowledge Service
(including any which contain personal information) is, of course, accessible
to only internet users you have authorised to access this information. We
are committed to protecting your privacy.
We are listed in the Register of data Controllers under the registration
number Z8022149 in accordance with the Data Protection Act 1998.
- The Present Knowledge’s Role
You as a Member or non-Member who visits the Present Knowledge Service,
recognise that we cannot be responsible or accountable for the behaviour
of Members - whether on the Present Knowledge Service or outside of it.
We only provide a service where the Present Knowledge Service may be accessed.
At The Present Knowledge we have no obligation to monitor the material contributed
by Members, however if brought to our attention a misuse of the service:.
We reserve the right (a) to suspend or terminate any Members access to the
Present Knowledge Service, or parts of it, and/or (b) to edit, or require
the Member to edit, material posted on the Present Knowledge Service, if
the relevant Member or material appears to us to be in breach of any provision
of this Agreement. You are responsible for everything, which is done on
or through the Present Knowledge Service while your Membership account is
logged on to the Present Knowledge Service, or through your email address(es).
If you see anything on the Present Knowledge Service which appears to infringe
this Agreement, then please contact us to inform us of it by emailing us
at report@thepresentknowledge.co.uk.
- Availability of The Present Knowledge Service
There may be times when The Present Knowledge reserves the right to withdraw
or modify one or more aspects of the Present Knowledge Service where we
have legal or technical reasons to do so (including technical difficulties
experienced by The Present Knowledge or on the Internet). Although The Present
Knowledge aims to offer you the best service possible, The Present Knowledge
makes no promise that the services at The Present Knowledge will meet your
requirements. The Present Knowledge cannot guarantee that the service will
be fault free. If a fault occurs in the service you should report it to
us via email at report@thepresentknowledge.co.uk.
and we will attempt to correct the fault as soon as we reasonably can.Your
access to The Present Knowledge may be occasionally restricted to allow
for repairs, maintenance or the introduction of new facilities or services.
The Present Knowledge will attempt to restore the service as soon as it
reasonably can. For security or other reasons, we may require you to change
password or other information,which facilitates access to the Present Knowledge
Service.
- Unlawful or prohibited use
- You are responsible for ensuring that your use of our Site is in compliance
with any applicable laws or regulations.
- You agree not to use our Site for any unlawful purpose.
- You agree not to restrict or inhibit any other User from using and enjoying
our Site including without limitation the following:
- using or attempting to use any Member Account without permission;
- obtaining or soliciting another person’s Password or other personal
information;
- impersonating another user or otherwise misrepresenting yourself to
us.
- You agree not to interfere or attempt to interfere with the operation
of our Site including the following: -
- interfering with or circumventing any security function of our Site
or attempting to do so;
- accessing or attempting to access any portion of our Site that you are
not authorised to access.
- You agree not to post or transfer to our Site any material which is
misleading, inaccurate, unlawful, threatening, defamatory, obscene, pornographic,
profane, or in breach of any copyright or other intellectua property right.
- You agree not to post or transmit any advertising, promotion or solicitation
of goods or services for commercial purposes or use the promise vouchers
available on the Present Knowledge Service for any business or commercial
purpose.
- You agree not to misuse any e-mail function available on or through
our Site and in particular you will not:-
- continue to send e-mails/time vouchers to a recipient if the recipient
has requested that you discontinue such communication;
- forge message headers or otherwise conceal an e-mail address or prevent
others from responding to a message;
- send bulk e-mails, spam, chain letters, "mail bombs" or other
disruptive transmissions.
- You agree not to use our Site to post or transmit any information or
software that contains a virus, worm, Trojan horse, or other harmful or
disruptive component or is damaging to data, software of the performance
of our or any other party’s computer system.
- You agree not to modify, adapt, translate, resell, re-transmit or disassemble
any part of our Site.
- Joining Fee
If we alter the amount of our joining fees, we will insure that such amount
is clearly stated at the time when you agree to join/renew the relevant
The Present Knowledge Service.
- Alerting The Present Knowledge
The Present Knowledge’s DISCLAIMER POLICY forms
part of this agreement. The Present Knowledge has no control over or responsibility
for the truth or accuracy of any material available on the Present Knowledge
Service, whether provided by Members or others.
- Intellectual Property
You acknowledge that The Present Knowledge Service owns all copyright,
and other intellectual property rights in and relating to the Present Knowledge
Service (including the material which is contributed by Members). It is
easy to copy material which appears on web-sites, but this does not mean
it is legal. Therefore, no one may copy, distribute, show in public or create
any derivative work from the Present Knowledge Service, or any of the material,
which is found on The Present Knowledge Service unless properly licensed
to do so by us.
- The Present Knowledge’s Liability
To the full extent allowed by applicable law, you agree that we will not
be liable to you or any third party for any consequential or incidental
damage, or for any loss of data, profit, revenue or business, howsoever
caused (whether arising out of any negligence or breach of this Agreement
or otherwise) The Present Knowledge Service will also not be liable for
any failure to perform any of its obligations under this Agreement caused
by matters beyond its reasonable control.
- Indemnity
You agree to indemnify, defend and hold harmless The Present Knowledge
against all liabilities, claims and expenses that may arise from any breach
of this Agreement arising out of your use of or conduct of the Present Knowledge
Service.
- Excluded loss
We will not be liable to you or any third party for any indirect or consequential
loss or damage, or for any loss of data, profit, revenue or business, howsoever
caused (whether arising out of any negligence or breach of this Agreement
or otherwise). The Present Knowledge Service will also not be liable for
any failure to perform of its obligations under this Agreement caused by
matters beyond its reasonable control.
- Assignment
Entire Agreement.This Agreement includes our
Privacy Policy and Disclaimer.
Together they contain the whole of the agreement between us and you concerning
the Present Knowledge Service and they replace all earlier agreements and
understandings with you. A person who is not a party to this Agreement has
no right under the Contracts (Rights of Third Parties) Act 1999 to rely
upon or enforce any term of this Agreement.
- Changes to this Agreement
The Present Knowledge reserves the right to change these Terms and Conditions
from time to time, and any changes will be notified to you via the e-mail
address provided by you on registration or via a suitable announcement on
The Present Knowledge site. You should assume that all material on the site
is protected by copyright unless otherwise noted. The Present Knowledge
may offer new or additional services through the Present Knowledge Service
from time to time. Your use of those services may be subject to additional
terms and conditions, or rules of use, which you must comply with. Provided
that those terms or rules are notified to you on the Present Knowledge Service
in an appropriate manner.The Present Knowledge reserves the right to change
this Agreement from time to time, and post the new version on the Present
Knowledge Service. When we do so, we will notify you of the fact that there
are changed terms on the main screen, and the new version of these terms
and conditions will take effect, and will govern all The Present Knowledge
Services and your relationship with The Present Knowledge.
- Severability
If any of these terms are determined to be invalid or unenforceable by
judicial decree or decision, the remainder of these terms shall remain in
full force and continue to be valid and enforceable.
- Law
This Agreement shall be governed by and construed in accordance with the
laws of England and Wales.
